International Court of Justice Grants Russia’s Counterclaim in Genocide Case With Ukraine

The International Court of Justice (ICJ) has ruled that Russia's counterclaim against Ukraine, in relation to the violation of the Genocide Convention, is admissible.
According to a statement on the ICJ website on December 8, the court confirmed that Russia's claim about Ukraine's “allegations of genocide” is “admissible as such and form part of the current proceedings” in Ukraine's case against Russia regarding the breach of the Genocide Convention.

The court also mentioned that “Russian Federation intends to rely, for the most part, on the same evidence in order both to refute Ukraine’s claim and to substantiate its own counter-claim.” As a result, the court will consider Ukraine's case as well.
The ICJ also rejected Ukraine’s request to dismiss Russia’s counterclaim related to the “allegations of genocide.”
Russia now has until December 7, 2027, to present its arguments regarding its counterclaim and Ukraine's response.

For its part, Ukraine must submit its response to the court by December 7, 2026.
On February 26, 2022, Ukraine initiated a lawsuit at the International Court of Justice against Russia, seeking to prevent and punish the crime of genocide.
Russia falsely alleged “acts of genocide: in the Luhansk and Donetsk regions of Ukraine, which led to the recognition of the self-declared "L/DPR" and the subsequent announcement of a full-scale invasion (referred to as the “special military operation”).

“Ukraine ‘emphatically denies’ that such acts of genocide have occurred and states that it submitted the Application ‘to establish that Russia has no lawful basis to take action in and against Ukraine for the purpose of preventing and punishing any purported genocide’”, the statement read.
Earlier, Ukraine’s Prosecutor General's Office submitted evidence to the United Nations, detailing over 190,000 war crimes committed by Russia since the beginning of its full-scale invasion.
